Terms of Service
Effective April 16, 2026
1. Definitions
"SERA", "we", "us", or "our" refers to the company and team that designs, manufactures, and operates the SERA smart thermostat platform. "You" or "your" refers to any individual, household, or organization that purchases, installs, or accesses the SERA device or any associated software or services.
2. Acceptance of Terms
By activating your SERA thermostat, creating an account, or using any part of the SERA platform — including the web app, mobile app, or API — you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
3. Device Use
SERA thermostats are designed for residential and light-commercial HVAC control only. You are responsible for ensuring proper installation in accordance with applicable electrical codes and the installation guide provided. SERA must be installed by a qualified professional where required by local law.
You agree not to modify, reverse-engineer, or tamper with the hardware or firmware of your device. Unauthorized modifications void your warranty and may create safety hazards.
4. Account & Security
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@sera.casa if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to keep credentials secure.
5. Subscriptions & Payments
Certain advanced features require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) using the payment method on file. By enabling auto-pay, you authorize SERA to charge your payment method automatically at the start of each billing period.
Payments are processed securely by Stripe. Stripe collects device and identifying information to operate its services and detect fraud. You can review Stripe's privacy practices at stripe.com/privacy.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Fees already charged are non-refundable except where required by applicable law.
6. Privacy & Data
We take your privacy seriously. SERA collects only the data necessary to operate and improve your thermostat — including temperature readings, schedule preferences, and device health diagnostics. We do not sell, rent, or share your personal data with advertisers or third-party marketers. Ever.
Data collected is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it for full details on what we collect, how we use it, and how you can request deletion.
7. Remote Access & Connectivity
SERA provides remote access to your thermostat via the internet. You acknowledge that internet connectivity is required for remote features and that network outages or maintenance windows may temporarily interrupt access. Your thermostat will continue to operate locally using its last saved schedule during any connectivity loss.
8. Software Updates
We may push firmware and software updates to your device to improve performance, security, or add features. Updates are applied automatically and you consent to receive them as part of using the service. We will not push updates that remove core functionality without prior notice.
9. Limited Warranty
SERA thermostats are covered by a limited hardware warranty for a period of two (2) years from the date of original purchase. This warranty covers defects in materials and workmanship under normal use. It does not cover damage caused by accident, misuse, unauthorized modification, or failure to follow installation instructions.
For warranty claims, contact us at support@sera.casa. We will repair or replace the defective unit at our discretion at no charge during the warranty period.
10. Supported for Life
We are committed to supporting every SERA thermostat for the life of your home. In the unlikely event that we discontinue the service, we will provide at least twelve (12) months' notice and ensure your device continues to function in local-only mode indefinitely.
11. Disclaimer of Warranties
Except for the limited warranty above, the SERA platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted service. SERA does not guarantee that use of the service will result in specific energy savings.
12. Limitation of Liability
To the maximum extent permitted by applicable law, SERA and its team shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the device or service. Our total liability to you for any claim shall not exceed the amount you paid for the device or subscription in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold SERA harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the device, or your violation of any applicable law.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Edmonton, Alberta.
